Terms and Conditions

These Terms and Conditions of Use ("Terms") govern the use of the Nidoo mobile application ("the Application"), the website ("the web"), and related services offered by Nidoo.

Before using our application, we recommend that you carefully read these terms and conditions of use. By accessing and using the Application, you agree to comply with these Terms. If you do not agree with any of these terms, you must not use the Application.

1. Use of the Application

1.1. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your device to avoid unauthorized access to your account. You agree to assume responsibility for all activities that occur under your account.

1.2. You agree that your use of the Application is subject to all applicable local, state, national, and international laws and regulations.

2. Application Features

2.1. The Application allows users to:

  • Add bills and expenses and consult bills through public utility company APIs, with user authorization.
  • Create and manage events and tasks.
  • Receive notifications to remember bill payments and events.
  • Create a family group and invite family members by paying for an application subscription.
  • Create a free account with limited features.
  • Access premium features.

2. Application Features, continued

2.2. Users have the option to upgrade to a premium membership that grants access to additional features or unlocks Application limits by paying the corresponding fee.

2.3. We provide these features to help users keep a record of their bills, events, and expenses. However, we are not responsible for bill payments or attendance at events. Users are responsible for paying their bills on time and attending the events they have created or to which they have been invited.

2.4. Users may use the expense control feature to monitor and manage their personal and/or family finances. However, expense data provided in the Application is for informational purposes only and does not constitute professional financial advice. We recommend that users consult a qualified financial advisor for personalized advice about their finances.

2.5. If the user enables automatic expenses, Nidoo may process the content of financial notifications authorized by the user to create expense records inside the Application. Nidoo does not request or store banking credentials, does not log in to bank accounts, does not directly query bank balances, does not make payments or transfers, and cannot operate on the user’s bank accounts. The user is responsible for reviewing the accuracy of records generated automatically.

3. Application features and subscriptions

The Nidoo application offers free features and others that require a paid subscription. Available subscriptions clearly specify details such as price, duration, and included services. The application may offer a free trial period at its discretion.

When purchasing a subscription, it may be necessary to provide additional information. The subscription price is the current fee shown in the application at the time of subscription and will be charged when activated, unless a free trial period is offered. In that case, the charge will be made at the end of the trial period unless it is cancelled early.

The user declares that they are fully authorized to use the payment method and have sufficient funds to cover the cost of the subscription. Nidoo will not be responsible for fraudulent use of bank cards or user accounts. The subscription begins at the time of activation and will be valid for the period chosen by the subscriber.

Cancellation: The Subscriber is informed and acknowledges that the services are offered through digital content, without physical support, and that provision begins at the time the service is subscribed to, with the Subscriber’s prior consent. Therefore, by using the services, the Subscriber expressly acknowledges that they waive their right of withdrawal once the subscription has been paid.

By subscribing, the subscriber accepts and acknowledges that the subscription will automatically renew according to the selected subscription period and that the corresponding amount will be debited from the provided payment method, in accordance with the service terms.

Any user may cancel their subscription at any time and without needing to justify the decision through the "Membership" section of their account. If the subscription was made through the Apple App Store or Google Play Store, recurring payments must also be cancelled in those app stores.

If a User breaches the General Conditions, or if a payment incident or non-payment of a recurring fee occurs, we reserve the right to cancel the User’s subscription without prior notice or warning.

In the event of a billing discrepancy, the Subscriber agrees to inform us as soon as possible, and no later than 15 days after the effective billing by Nidoo.

4. Intellectual Property

4.1. All content included in the Application, such as text, graphics, logos, button icons, images, audio clips, digital downloads, and data compilations, is the property of Nidoo or its content providers and is protected by copyright laws and other applicable intellectual property laws.

4.2. You may not copy, reproduce, modify, distribute, display, sell, or transmit any Application content without Nidoo’s prior written permission.

5. Limitation of Liability

5.1. In no event will Nidoo, its directors, employees, affiliates, agents, contractors, or licensors be liable to you for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Application.

5.2. Nidoo does not guarantee that the Application will be error-free or available at all times. Application availability and performance may be affected by factors outside Nidoo’s control, including, but not limited to, network issues, mobile devices, and technical issues from third-party service providers.

6. Prohibited Use

You must not use Nidoo in a way that may:

  • Violate any applicable law or regulation.
  • Infringe intellectual property rights or other third-party rights.
  • Be harmful, fraudulent, defamatory, obscene, or offensive.
  • Be used for illegal purposes.
  • Ask others to perform illegal acts.
  • Harass, abuse, insult, harm, defame, denigrate, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, nationality, or disability.
  • Submit false or misleading information.
  • Upload or transmit viruses or harmful code.
  • Collect or track personal information from others.
  • Send spam, perform phishing, or use unauthorized tracking techniques.
  • Interfere with the security features of the Service or any related website.
  • Perform activities that overload the service infrastructure, including mass data transfers, high bandwidth consumption, excessive storage use, hosting web servers, internet relay chat servers or other servers, and non-traditional end-user conduct.
  • Attempt to access, search, or extract data from any service or website with unauthorized tools, such as engines, software, agents, robots, spiders, or scrapers.
  • Present any service or website in a way that suggests a relationship with Nidoo or an endorsement by Nidoo for any purpose.

7. User Responsibility

Users are responsible for the content they generate in Nidoo and for their interactions with other users. Nidoo is not responsible for user-generated content.

Parents must supervise their children’s content and activities to keep them safe online. Nidoo is not responsible for content created by the user. The decision to view content or interact with others is yours. We advise you to use your judgment when interacting on the platform.

8. Bill Account Number Queries

Purpose: In our application, when users want to register public utilities, we request the account numbers of bills provided by users who must have some relationship with the property. This allows queries through public utility company APIs for consumption, payment due date, and bill amount.

This information is used exclusively to obtain the payment due date, consumption, and bill amount, and to notify the user when a bill is available for payment and what its amount and payment due date are.

The processing of this data is based on user consent, granted when entering account numbers in our application and accepting the service query with the provider while having a relationship with the property to be registered and queried. This processing is necessary to notify when a bill is available for payment and to inform the user through notifications of the amount and due date.

User responsibility: The application acts only as a bill query and notification tool for public utilities on behalf of the user. We are not responsible for non-payment of bills, late fees, service suspension, or other consequences derived from lack of payment.

It is the sole responsibility of the user to ensure that bills are paid on time and in full. The application does not guarantee the accuracy, completeness, or timeliness of notifications and information. We recommend that the user validate information directly with the service provider and verify amounts before making any payment.

Security Measures: We take technical and organizational security measures to protect users’ personal data against unauthorized access, alteration, disclosure, or destruction. Query data is transmitted securely and stored so that only authorized personnel can access it.

User Rights: Users have the right to access, rectify, delete, and object to the processing of their personal data, as well as to exercise other rights recognized by applicable data protection regulations. To exercise these rights, users may contact us at nidhoo@nidhoo.app.

9. Modifications

We reserve the right to update these Terms at any time. You will be notified of any change by publication of the revised Terms in the Application. Continued use of the Application after the publication of changes will constitute your acceptance of them.

10. Applicable Law

These terms and conditions are governed by the laws of Colombia. Any dispute arising in connection with these terms will be subject to the exclusive jurisdiction of the courts of Colombia.
